RECONSTRUCTION OF INDIVIDUAL RESIDENTIAL HOUSES: IMPLICATIONS FOR URBAN CADASTRE DATA ACCURACY

Abstract

The article aims to highlight the importance of including information about the reconstruction of individual residential houses in the Ukrainian urban cadastre. This inclusion is crucial due to its impact on building density, infrastructure needs, and the legal status of real estate. To conduct this study, several methods were employed, including a legal analysis of Ukrainian legislation (such as the Civil Code, the Law on Regulation of Urban Development Activities, and the Law on Peculiarities of Exercising Ownership Rights in Multi-Apartment Buildings). Additionally, state-building norms were reviewed, and an urban-planning analysis was performed on cases of apartment-to-house transformations. The research demonstrates that the reconstruction of residential buildings significantly alters their area, volume, number of floors, and functional purpose, thereby affecting the relevance of urban cadastre data. The study identifies the legal and technical foundations for transforming the status of apartments into detached houses, as well as the challenges associated with land privatization. A key contribution of this research is the proposed comprehensive approach to reconstruction. This approach views reconstruction not just as a technical modification but also as a transformation of legal status, necessitating systematic documentation in the urban cadastre. The findings can be utilized to enhance cadastre maintenance procedures, ensure the accuracy of data for territorial development planning, and address co-ownership legal issues during land privatization processes. Future research should focus on developing methodological recommendations for recording reconstruction data in the urban cadastre and analyzing the socio-economic consequences of housing transformation in light of modern challenges, such as war
