ASSESSMENT OF DAMAGES DETERMINED DURING LOSS, DESTRUCTION OR DAMAGE TO REAL ESTATE IN CONNECTION WITH ARMED AGGRESSION

Kostiantyn Mamonov Vasyl Goi Yuliia Radzinska Roman Vyatkin

Abstract

It has been proven that in modern emergency conditions, which are determined by the influence of a wide range of factors characterizing the formation and implementation of land relations, the level of real estate use, it is necessary to rethink approaches to its assessment, taking into account the negative consequences of the aggression of the Russian Federation. In this context, it should be pointed out the significant destruction of real estate and the need for its reconstruction at the regional level. The multifacetedness of established losses in the field of formation and use of real estate, as a result of the aggression of the Russian Federation, is determined. Thus, the issues of damage assessment determined during the loss, destruction or damage of real estate in connection with armed aggression require further research and are determined by the urgency. The purpose of the study is to substantiate the directions and features of damage assessment determined during the loss, destruction or damage of real estate in connection with armed aggression. In order to achieve the goal, the following tasks were solved: the formation of a categorical apparatus for determining losses determined during the loss, destruction or damage of real estate in connection with armed aggression; systematization of regulatory legal support for real estate valuation, taking into account the specifics of the formation of the presented losses. As a result of the study, directions for the formation and assessment of losses determined during the loss, destruction or damage of real estate in connection with the armed aggression of the Russian Federation were determined. The multifaceted nature of determining the areas of real estate valuation and taking into account the consequences of the Russian aggression in this context is proven. A categorical apparatus for determining the loss of destruction or damage to real estate has been formed in the legal framework. However, the areas of real estate evaluation are insufficiently substantiated, identifying problematic aspects related to the consequences of the Russian aggression
